Comes
now into court Michael E. DiRosa, a Citizen of the State of
Louisiana, appearing in proper person, unschooled in the law,
demanding all of his rights under the Constitution of the United
States and the Bill of Rights to move this court for leave to file
the attached complaint and briefs in support In Forma Pauperis.
The
Plaintiff, Michael E. DiRosa, in the entitled action is completely
without means, is heavily in debt, and has been reduced, by the
illegal and unconstitutional laws of the State of Louisiana to a
pauper with his survival dependent on the kindness of others. Were
this kindness to be withdrawn I would be homeless and totally without
means.
As the
attached complaint, briefs and supporting documents will undeniably
prove, I am forbidden, by the Constitution of the State of Louisiana,
the right to own and use any
“device by which persons or things may be transported upon a
public highway or bridge.” La R.S. 32:1(92) This includes
bicycles and ridden animals. Hence, I have been imprisoned, absent
charge and trial, to little better than house arrest. I am only
allowed to travel as far as I can walk in a day. I am forbidden by
law to even own or use an emergency evacuation vehicle.
My plight is dire. Since the State of Louisiana has
forbidden me the use of any means of locomotion, save walking, I can
not support myself. I can not even flee for my life. I am to be
left to die when the next man made or nature sent disaster should
befall this area. I have already bested my last three executioners,
hurricanes Katrina and Rita and the flooding of New Orleans by the
Corp of Engineers. I do fear that my next executioner may be more
successful. Hurricane season is upon us and my next executioner
could come as soon as tomorrow.
Copy machines, post offices and law libraries are
beyond the bounds of my prison as are printer ink and paper. Even
the simple act of acquiring food is a Herculean task as, since the
flood, even public transportation has not been restored to this area.
I have even had to borrow the money to supply these ten copies and
the postage necessary to motion this Honorable Court .
For the above stated reasons I do move this Honorable
Court to issue an appropriate order to allow this action to be
commenced, by this Plaintiff, in forma pauperis.
I do hereby affirm that the above is true and correct
to the best of my knowledge.
