Comes
now into court Michael E. DiRosa, a free and natural born Citizen of
the State of Louisiana, appearing in proper person, unschooled in the
law, demanding all of his rights under the Constitution of the United
States and the Bill of Rights, to demand a Trial by jury of twelve of
my peers, free State Citizens not bound to service to the corporate
body known as the Department of Safety and Corrections nor any
corporation in the Insurance Industry, and the compulsion of
witnesses in the above entitled action.
This
Defendant does, again, challenge the jurisdiction of this court, a
challenge that has not, to this day, been rebutted. This Defendant
is forced, against his will and over his unrefuted objections, to
defend his life, liberty and property before an impotent court.
As a
Citizen of the State of Louisiana I do hereby DEMAND a trial by a
Jury of twelve of my peer in a Constitutional Court as is my right as
I am charged with infamous crimes and am in eminent danger of the
loss of Life, Liberty and Property. I do also hereby DEMAND that the
jury be empowered to try the law as well as the facts, as is my
right.
I do
also DEMAND that Summons be issued by this court to compel Richard L.
Stalder Secretary of the Department of Public Safety and Corrections
to appear and give testimony at the trial. There can be no doubt
that the appearance of Mr. Stalder, at the trial, is essential to
this Defendant's defense. As head of the body corporate known as the
Department of Public Safety and Correction, overseer of the State's
plantation, the complainant in this matter, only he can answer
questions pertaining to the complaints which he himself, through his
agents, has brought against me. He has, as the record should clearly
show, been kept abreast of, and is personally aware of my challenges
to his repeated complaints. I do DEMAND the right to face my
accuser.
The only
address, known to this Defendant, of Richard L. Stalder Secretary of
the Department of Public Safety and Corrections is at P.O. Box 66614,
Baton Rouge, LA 70896-6614. However, since this is the complainant,
the counsel representing the State of Louisiana, who's name I do not
know as I have never been officially informed nor seen him / her /
them at any proceeding to date, surely must be able to provide. I
am, in fact, demanding that the Plaintiff produce the complainant at
the trial.
I do,
again, notice this court and all parties that I do maintain my
challenge to the jurisdiction of this court until such time as the
record clearly shows, and this Defendant is clearly informed of, the
jurisdictional grounds on which I have been dragged, at the literal
gun barrel of government, into this court, the standing of the
Plaintiff and the cause of action of the Plaintiff. Until such time
as jurisdiction is proved, and not presumed, I do refuse to motion an
incompetent court least someone, by some fantastic stretch of the
imagination, contend that my challenge of jurisdiction has been
abandoned. I do, again, state that until such time as jurisdiction,
standing and legal cause of action is proved, clearly in the record,
by the plaintiff, as is their burden, I do challenge the jurisdiction
of this court. My challenge of jurisdiction has never, to this day,
been rebutted.
I do

ORDER
It is hereby ordered that this case be scheduled for a
jury trial. It is further ordered that Richard L. Stalder Secretary
of the Department of Public Safety and Corrections be summonsed to
appear and give testimony at the trial and that Summons ensue and
that service be at the address known to the unknown District Attorney
and upon whose complaint this action is brought.

I,
Michael E. DiRosa, do hereby certify that I have delivered a true
and correct copy of the foregoing document on this 6th, day
of April, 2007, by either
with bond servant / slave escort or in open defiance of the tyrant
and overseer of the State's plantation, by use of my self
propelled motor vehicle known as a bicycle, to the United States
Postal Authority where I did place into their custody a certified
letter, return receipt requested to the Clerk of
that Court containing one copy of this document for the Court and
a separate copy for the unknown Prosecuting Attorney.
